Is there a time limit for submitting a claim for personal injury?
There is a statutory limit of three years from the date of the accident and a claim can be submitted at any stage during this period.
How long will a claim for personal injuries take to settle?
Straightforward injuries should be resolved and settled within a twelve month period. However, it will largely depend on the nature of the injury involved.
Do I need to have reported my injuries to my GP or Hospital?
If you have not been to visit your GP or hospital it should not prevent you from presenting a claim. However, it will greatly assist your claim if you have a written record of your injury either at your GP or Hospital.
Can I be compensated for losses other than personal injury?
You are entitled to recover any loss which you incur as a result of an accident including damaged clothing, expenses and loss of earnings.
What is "No Win, No Fee"?
No Win No Fee arrangements also known more specifically as Conditional Fee Arrangements (CFAs) means that if you do not win your accident claim, you do not have to pay your solicitor a fee.
Insurance will cover you against the other side's costs and expenses should the claim be unsuccessful. If you win your case you should receive your compensation free of any deductions, as your solicitor's costs should be paid by the other side.There are very few exceptions to this. No win no fee was introduced to the UK in 1995, and replaces legal aid, a government enabled system for providing funding to help people get a fair hearing; access the court process; and help solve problems that contribute to social exclusion. The new system shifts costs from the legal aid system, and removes an application process to satisfy an independent regulator that there is a reasonable case. Instead these decisions are now up to the discretion of the solicitor. Therefore the no win no fee agreement occurs between the law firm and the client.
